While many kindergartens or training institutions conduct simple interviews with foreign teachers dispatched by intermediary agencies, they do not strictly review their sources, resumes, etc.


At the same time, as parents of consumers, there is little awareness or opportunity to understand whether the "foreign teachers" hired by kindergartens are illegal workers in China. However, some "black foreign teachers" who illegally work not only have a low level of education and lack teaching ability, but also have serious moral misconduct, posing serious safety risks. According to Article 80 of the Law of the People's Republic of China on the Administration of Exit and Entry, aliens who illegally engage in employment shall be fined not less than 5000 yuan but not more than 20000 yuan; "If the circumstances are serious, he shall be detained for not less than five days but not more than 15 days, and shall also be fined not less than 5000 yuan but not more than 20000 yuan.". "Personnel or institutions that introduce illegal employment of foreigners should not assume that they can go unpunished, because Article 80 of the Law of the People's Republic of China on the Administration of Exit and Entry also stipulates that individuals who introduce illegal employment of foreigners are subject to a fine of 5000 yuan for each person illegally introduced, with a total amount not exceeding 50000 yuan."; The unit shall be fined 5000 yuan for each illegal introduction, with a total amount not exceeding 100000 yuan; "If there are illegal gains, the illegal gains shall be confiscated.".


In addition, if an institution finds qualified foreigners and wants to hire them as "foreign teachers", it needs to go through legal procedures with the local science and technology department (or bureau) and the entry and exit management department of the public security organ. Incomplete procedures or private use of "foreign teachers" from other institutions are considered illegal employment of foreigners, and once verified, they will also face penalties: Article 80 of the Exit and Entry Administration Law of the People's Republic of China also stipulates that illegal employment of foreigners is subject to a fine of 10000 yuan for each person illegally employed, with a total amount not exceeding 100000 yuan; "If there are illegal gains, the illegal gains shall be confiscated.".
